It depends on the nature and extent of your husband's estate. If your husband only owned only personal property like clothes, furniture, and household items, you may not need to probate his estate. On the other hand, if he owned real estate, stocks, bonds, automobiles, or anything else with a recorded legal title, you may need to probate the estate.
Also, if he had any children, you will probably want to probate his estate so that ownership of any property passes to you and not to them. You should consult a probate lawyer in or near the county where your husband was living at the time of his death.
