Q: I have a utility trailer titled as Home Made in Florida. I am thinking of selling it. Am I considered the manufacturer?

A: The following comments are for informational purposes, not legal advice (for which you'd need to schedule a consultation with an attorney). You did not indicate if you made the trailer. Maker = manufacturer. Generally, a manufacture of anything that causes injury or damage due to negligence in the MAKING of the item may have potential liability even though not the owner of the item - for example, if it were to fall apart on the road due to faulty workmanship, causing parts to strike persons or vehicles. A manufacturer is not liable for a subsequent owner's negligent use of the item - for example, if the subsequent owner swerves, causing the trailer to swing into another vehicle (and without faulty workmanship being a factor in any way).
