Q: Does a physician (me) have an obligation to report someone who lied on a DOT application and is an at risk CDL driver?

Patient presented for surgical clearance. Has diabetes-on insulin-self treats-with episodes of high/low sugars. He does not disclose on his DOT exams and adjusts his meds so that the urine testing is negative. As a CDL driver, he is obligated to report for safety reasons and he is not optimally managed. Thank you.

A: It is important for all medical providers have a health care attorney to advise them on the normal issues, such as this, that come up, day to day. If you work for a health care system or combined practice, they should have corporate counsel with whom you can confer. The consequences are too dire and risks to you too high to rely on offhand remarks on a website.
