Q: Is it legal to search a vehicle if the traffic stop is unlawful or non existent?
I was driving when a cop got behind me. After a block or so I parked my car and exited my vehicle. They decided to turn on they're lights and arrest me after I was away from my vehicle. They searched my vehicle and am being charged with other crimes. Being that it wasn't a traffic stop is it lawful to search my vehicle?
A: An attorney will need to evaluate the entire situation to determine whether it was an illegal search. You apparently think because you parked and were walking away from the car it was off limits. I am not sure a judge is going buy it.
