Q: If a NCP overpaid in childsupport in which was sent to CP is the NCP entitled to receive the $ that they overpaid back?
If a non custodial parent has over payed child support that was sent to custodial parent is the NC parent entitled to receive the overpayment $ sent back to them? My husband had an overpayment on his CS account of $1,000+ but the CS office said they already sent it to CP and they couldn’t ask CP to pay it back!? If this is really true please excuse my French but it bulls*it…. And it’s not even right that a NCP will be hunted if they don’t pay but if CP receives too much they just get to keep it…
A: Yes. You will need to make a motion in the child support case for a credit for the overpayment.
