Q: What are my rights as far as what say I have in my child’s care after DCFS has removed her from failing a drug test ?
A: You should probably hire an attorney. But the best thing you can do now is stop using drugs and follow the case plan. They will give you a case plan to follow to help you get her back. Best of luck.
A: Reunification (getting your child back) is going to be a process. Most parents find this process a lot less frustrating when they have an attorney representing them. Without an attorney you may find social workers and attorneys for the state who do not want to communicate with you, judges who you feel aren't listening to you, and it may be hard to get temporary visitation. The best thing for you to do is to hire a lawyer to represent your interests, and make sure that you can pass random drug tests that will likely be coming in the future. If you don't hire an attorney, follow the case plan provided to you, pay any temporary child support ordered, be present for any temporary visitation you are given, keep your house in order for any home visits, and make sure you are in court for any hearings.
