Oklahoma City, OK asked in Car Accidents for Oklahoma

Q: If I hit an awning at a drive-through restaurant, and there was not a clearance warning sign, who is at fault?

I was going through taco Bueno, and as I am pulling off from ordering my food, I heard a noise I look in my mirrors and I noticed that my cargo trailer has hit the awning above the drive-through menu. got out and looked did not really see any damage. I looked to see if there was any warning, clearance, height, signs, or anything, and there was not there was only a black awning that I didn’t even see to begin with(no bright colors or anything, and no numbers no warning) so I walked up to the window and I told the girl what happen she looked at it and she said oh no worries no big deal so I proceeded to get my food & left four days later I have a sheriff, knocking at my door, telling me that I need to get in contact with the sheriff of said jurisdiction. I was in complete shock I called him immediately. He told me that I would need to come that next day and speak to him well I did, & I received a ticket for leaving the scene of a property accident

A: An Oklahoma attorney could advise best, but your post remains open for two weeks. First priority is to address the citation for leaving the scene of an accident. You could reach out to attorneys - it isn't likely that someone here would be able to respond with meaningful step-by-step instructions - they would likely want to discuss the incident in further detail with you. It's also possible that the restaurant could assert a property damage claim - if that arises, you could look into whether your auto insurance carrier would handle it. Good luck
