Apopka, FL asked in Employment Law, Business Law and Construction Law for Florida

Q: Can we recoup damages?

We had an independent contractor help us at a daily rate. We own a handyman business and needed an extra set of hands. He botched the job significantly and caused property damage to our home and property. Our truck has overspray all over it, drive way is covered in paint, mailbox covered in paint and stripped in places where he apparently used the pressure washer to try and cover the paint damage. I terminated his services via text and explained the reason. He responded that I was harassing him by requesting the uniform back that we supplied and for the cost of paint which he stated in text he would pay for given the job was done so poorly. He stated it is harassment for me to have sent the text and ended that he will see me in court. Even though there were damages and the job was done so poorly we did pay him.

Can we request compensation for the damages and the loss? We also lost the client due to the delay he caused.

A: Yes, sounds like you may have a claim for damages. The question is- how much? It may or may not be worth hiring a lawyer.

Good luck.
