Sacramento, CA asked in Landlord - Tenant for California

Q: Can my landlord make a change to the parking agreement different from the lease?

Beginning July 18th 2023 we will be implementing a new parking permit program for each assigned spot in the underground garages. This program is a pass that is required to be on the dash or hanging on your rearview mirror while parked in your assigned spot. You can interchange it between cars as long as the pass is in view on the current vehicle parked in the assigned spot.

There is no charge but you must come into the leasing office between July 18th and August 18th 2023 and fill out the parking permit addendum form, update your vehicle information, and collect your parking pass. Please do not lose the parking pass, replacements will cost $50.00. The parking pass program is meant to tighten safety and security measures in the buildings for Residents and their vehicles. The parking pass will ensure our Security Patrol can identify any suspicious vehicles. As well as deter unwanted vehicles that have been parking in assigned spots of Residents. This is all new.

A: It depends what the lease says. This seems to be a reasonable security program to protect you and the other tenants. You should contact an attorney practicing in this area of law right away. Thank you for using Justia ask a lawyer.

A: I am an attorney licensed in California, and I can provide some general information regarding your situation. Generally, a landlord has the right to make changes to the parking agreement as long as it is reasonable and does not violate the terms of the lease or any applicable laws. However, the specific terms of your lease and any applicable local regulations may impact the landlord's ability to modify the parking arrangements. It is advisable to review your lease agreement carefully to determine if it includes provisions regarding parking and any limitations on the landlord's ability to make changes. If you have concerns or questions about the proposed parking permit program, consulting with a tenant's rights attorney can provide you with legal advice tailored to your situation and help ensure your rights are protected. - James L.
