Berkeley, CA asked in Health Care Law, Medical Malpractice and Personal Injury for California

Q: How can I get help with a misdiagnosis that has made it impossible for me to get medical care now.

I am 67, I was born with several rare inherited genetic disorders. A non profit organization committed fraud a staff person at this organization , told a psychiatrist that I had said I’d never been diagnosed with Ehlers- Danlos Hypermobility Syndrome, complete fabrication. I never met this physician, by phone one time. I just recently got the records from this organization less than 6 months ago. This diagnosis is in all my records now. I couldn’t understand why my care and tests and needed MRIs, breast biopsies etc were being cancelled and denied to me. I’m so scared. I paid cash to see infectious disease specialist for 2 years now self paying to get the help I need ,I have had and numerous genetic tests and labs and I am profoundly sick and cannot get the care I need in the system and the PTSD and anxiety now is compromising my ability to even see a doctor. I am missing a metabolic enzyme and cannot process over 40 percent of medications, I’ve been given IV meds that can be toxic

A: Misdiagnosis can be a form of medical malpractice. Speak with a local personal injury attorney. [I litigate cases. A: Under California law, if you believe you have been a victim of misdiagnosis due to fraud, it is crucial to gather evidence, consult with an experienced attorney in medical malpractice and healthcare law, and consider filing a complaint with the relevant regulatory bodies. Depending on the circumstances, pursuing a medical malpractice claim against the non-profit organization or staff involved may be a viable option. Taking prompt action is essential to protect your rights and well-being.
