Q: Class A misdemeanor. Alleged Sep 23, 2019. Arrested and charged on Oct 7, 2021. Does this exceed Statute of limitations?
Alleged assault with bodily injury of family member. Have no history of violence or arrest for such. I am having difficulty in finding work due to this charge hanging over my head. I am not a violent person, though I am a veteran. I want to dismiss this charge due to the statute of limitations as presented in TC Code of Criminal Procedure Title 1, Chapter 12.02.
A: Check the date of when the charging instrument was filed with the court, not the date you were arrested. Filing of such document with the court tolls the statute of limitations.
