Winchester, KY asked in Criminal Law for Kentucky

Q: Can I be charged with tbut when I didn't have any of the stolen items?

I was charged with misdemeanor receiving stolen property. I handed item over to police. when I went to court I was told 10 days in jail or restitution, I choose restitution but then I've found out that I'm being made to pay back the entire amount of items that supposedly where stolen from a lady's home almost 5k. I have no knowledge of what items are missing, I didn't break into anyone's home nor do I know who did. I bought the item I had at a yard sale and posted on social media to resell to try and make a profit. When I went back to court for show cause I wasn't able to pay the entire amount but paid almost 2k. Now the case is being sent to circuit court and I am now being charged with Tbut! I wasn't in possession of any other items, there is no evidence of me breaking into this home (cause I didn't), I haven't been questioned by police except for day I received ticket and handed item over then. How can I be charged with a crime I didn't commit? I need help!

A: You need to hire an experience criminal defense attorney immediately. If you did not commit any crimes other than buying an item at a yard sale, then you should not be charged with theft unless you definitely knew that item was stolen or you had a part in the theft.
