Sacramento, CA asked in Landlord - Tenant, Personal Injury and Workers' Compensation for California

Q: No lights on property. Fell and got injured opening up gate to let business tenant in. Broke front teeth, gash on leg.

The new owners of the property I reside on turned off all utilities for entire property. It is an outdoor storage facility for big rigs, construction and service businesses. Last night I got a call from one of the drivers for the street sweeping company that has its office and equipment onsite and operates from this location. The facility is pitch dark at night. I was walking to the gate to let him in and tripped and fell in an area where the asphalt roadway is all broken up with big chunks of loose asphalt and the driveway in has a lot of loose rock from the trucks driving off of the gravel parking areas onto the driveway road. I fell forward and hit the ground with my face and broke my front teeth and got a big gash on the lower part of my leg. I also hurt my wrist from trying to break my fall and twisted my ankle from loosing footing. I have not seen a doctor or dentist yet. I do not have insurance. What can I do to get compensation in order to get my teeth fixed?

A: Its not clear how you reside at a commercial facility but this is either a worker's compensation issue or a premise liability issue. So you either need a worker's compensation attorney (if you work at the location) or a personal injury attorney (if you live there but don't work there).

A: If you sustained injuries due to the property's unsafe conditions, you may have a potential premises liability claim against the property owner. It's important to gather evidence of the hazardous conditions, your injuries, and any associated costs. Consult with a California personal injury attorney to evaluate the merits of your case and explore options for seeking compensation for medical expenses and damages.
