Q: neighbor dog trespassed into my yard and he got in a fight with my dogs and he got hurt. My dogs didn’t. Who is liable

A Neighbor down and across the street had a broken invisible fence and knew it was broken. He continued to let his dog out anyway and multiple neighbors including myself, my wife, and my 8 yr old son had returned him to his house over a couple month period. I did leave my privacy gate open by mistake one evening and the neighbor dog came into my yard at the point when I did leave the gate open. The neighbor dog did not go in the gate area where my dogs are kept. My dogs were able to access our driveway area because of the open gate. The interaction between the dogs started there and continued into my neighbors yard where my wife broke it up. The neighbors dog was bitten multiple times and from what I could tell my dogs sustained bites but nothing they couldn’t handle and heal on their own and they did. The other dog had to get surgery

I did have an issue a while ago.

5 and half yrs ago I didn’t have a fence and my dogs did chase my Immediate neighbor and bit them on the leg

A: His problem and his fault. You are not liable.
