Q: How do we cancel out a medical power of attorney? State of Tx

My husband's mother called him over about 8 months before our wedding. She had him sign a form for a medical power of attorney and as he was just trusting of his mom, he asked no questions. Fast forward, I accidentally found the forms and some how they were legally done and filed. I asked my then fiance about it and he was confused. After the wedding we asked his mom about it and she said it was exactly that. He is 100% healthy and he did not know what he was signing and is wishing he didn't. She also hinted maybe there is a life insurance policy now but would neither confirm nor deny. We are worried what this means for us in the future. Does it give her access to things does it mean all my power as his wife is gone if something happens. Neither one of us wanted this and we know she has been having trouble accepting her son being an adult. But now we are in a situation that neither of us know how to navigate.

A: A medical power of attorney allows the agent (his mother) to make any health care decision he could make for himself if he is unable to do so.

You can have him sign a new power of attorney naming you as his agent and revoking his previous power of attorney to his mother.
