Houston, TX asked in Real Estate Law for Texas

Q: My neighbor built a fence on my property. I been there 31 years, him 21. Claim it's his property. What do I do?

I've had a demand sent to him but he has failed to remove the fence. Should I file trespassing against him & file against who he claimed did a survey on property without my permission in my absence from my home. Do I have the right to remove the fence myself? I'm a Senior on a fix income. It is already adding to my financial burden. I have before pictures and after.

A: I would like to know how far his fence encroaches on your land.

The best way to deal with your problem is to get a survey and have the surveyor mark the boundary lines, or hire a lawyer to deal with your neighbor. Then, if his fence is on your land, you should send him a certified letter telling him to remove the fence within 10 days, or you will have it removed at his cost. If that doesn't do it, then you can call the Sheriff to tell him to remove it, or sue him in court for trespass and other causes of action.

I hope this helps.
