A: $0 is the least amount that a plaintiff can recover for a slip and fall.

As always, every case depends upon its own facts and circumstances. A defendant in such a case is usually a party who has control of the premises where the slip and fall occurred. Such a party has to duty to invitees to warn or make safe a concealed unreasonably dangerous condition of which it has knowledge.

It is not uncommon in a slip and fall case for a jury to find the condition wasn’t concealed but was open and obvious. It is also not uncommon for a jury to find it was not unreasonably dangerous. Finally, it is not uncommon for a premises owner not to have knowledge of the condition.

Many plaintiffs in such cases settle for “cost of defense” rather than run the risk of getting nothing at trial.

A: It could depend on a number of factors, a major one being liability. It is difficult for attorneys to speculate on dollar figures. A North Carolina attorney could advise best after seeing the case file. Good luck
