Q: I am in need of urgent legal advice regarding a lease termination situation.
I am currently a tenant at an Apartment Complex and am scheduled to move out in one month. Unfortunately, I find myself in a situation where I need to terminate my lease with the least possible repercussions.
Over the past five months, I have been experiencing severe disturbances caused by my upstairs neighbors, including a yelping dog in the middle of the night, loud stomping, yelling, crying, and even a trespassing incident onto our porch. Despite multiple attempts to address the issue with the property manager and involving local law enforcement, no tangible resolution has been achieved.
This situation has left me feeling unsafe and apprehensive, to the extent that I am fearful even to exit my front door. Consequently, I have made the decision to secure alternative housing and will be vacating my current apartment by the end of next month.
Given my limited income, I am particularly concerned about the potential financial implications of breaking the lease.
A: Ordinarily, you will be liable for rent for the balance of the lease term minus any rent the landlord may receive from a new tenant may pay for the balance of the lease term plus the landlord’s cost, if any, of reletting (eg advertising, broker commissions, etc)
