Q: what does AS.23.30.015(g) mean to an employee?
A: For example, you are in an accident with another driver unrelated to your employment, who is liable for the accident while you were on the clock with your employer. As a result of being on the clock, you filed for Worker’s Compensation and you received benefits under Worker’s Comp. You then filed a lawsuit against the other driver and recovered damages. Other than attorneys fees and costs the remainder of the money may have to go to Worker’s Comp to reimburse them for the payments that they made to you and your medical providers. It is therefore important that your PI lawyer is familiar with the Worker’s Comp. statute and can possibly negotiate a deal so some of that money will go into your pocket.
