Q: Pulled over for speeding, double parking ticket was issued, instead. I was not speeding. Need help/advice, options?
I was pulled over for speeding, even though I was not. Cop said he clocked me in a lane that I was not in. Cop issued a dble parking ticket. I contested, had an informal zoom hearing. The cop stated in the hearing that he didn't remember any of the details and that he was moving to dismiss. The judge did not hear him or did not take it into consideration. Gave me two options, pay dble parking or speeding ticket with the option to appeal. I paid the bond. I Have a formal hearing scheduled to fight the speeding ticket. In the meantime, I've been issued a letter from SOS for a BDIC that I must complete by a certain date if I don't want pts on my license. The thing is, my appeal date isn't scheduled until after the deadline for the course. The court and the SOS say that they can't do anything about it. One said the other has to change the date of the "abstract" and vice versa. How do I proceed? Who should be able to assist me? I don't want to pay for the course if I win my appeal.
A: The court is the one that reports - or "abstracts" - data to the Secretary of State, so they would need to change the date.
