Q: Can I still sue a dentist for malpractice after signing a release and getting full refund of $70,000 in FL.
I can’t eat and my top full arch still isn’t complete. I had a life threatening infection from a bad implant. Dr. Sulens agreed to pay all hospital bills and the implant restoration. Dr. Farrugia took 3+ years. I was fed up demanding a refund & I signed an agreement releasing all parties; it wasn’t notarized. I am a pretty girl that will never enjoy food; I’m tiny. The doctor shouldn’t have done this to my teeth; they were beautiful. After spending 9 days in the hospital in FL the infection returned after relocating I found a Dr. in Naples with fantastic reviews & trusted what he said was necessary. The OH doctor agreed to pay $78,000 because he was responsible . I didn’t want to sue anyone. After 3+ years this still isn’t complete. I can’t eat and my life will never be the same. I have had others opinions and his work is incorrectly done. I have had a 2nd spinal fusion and hip & femur surgery. I have fully recovered in less than a year, yet my restoration isn’t done….desperate!!!
A: Probably not but it depends on what the release states and other factors.
