Q: I was arrested in April 2023 during a traffic stop on an FTA warrant.

I was arrested in April 2023 during a traffic stop on an FTA warrant. At the jail I was given jail attire to change into. During my dress out the officer found a bag of Methamphetamine inside my underwear, the jail officer contacted the arresting officer to inform him and he came back to the jail to collect the evidence. It was field tested and presented as evidence, for the charges filed against me on may 30, 2023. I appeared in court by video from jail for my initial hearing in this cause and was advised my charges a level 6 felony possession of meth and Identity deception. I plead not guilty. I was released from jail in July after posting a 2,000$ bond. My lawyer has filed 3 continuances my court date is now 12/11/23. But on 11/29/23 new charges were filed against me for possession b/t 10&28 and identity deception again and issued a warrant for my arrest. These charges were based off the drugs that they used to charge me in the first case. Is this legal?

A: You should discuss this with your attorney. If in fact both are from the same incident, then he/she should request the warrant be recalled.
