Queens, NY asked in Tax Law for New York

Q: I am a senior citizen on a fixed income. Yesterday I received 3 notices from the nys tax people. It seems they have gone

Back to 2011-2013 and billed me for several thousand dollars. But their website says to hold returns for 3 years? I have never intentionally cheated on taxes.

Any advice???

A: You can contact New York state to conduct a compliane check. If you do owe the taxes, you may qualify to file an offer in compromise to settle your tax debt.

A: The first step is to compile all of your tax records. Contact previous employers or state agencies where you received your income and ask for the applicable tax forms that were filed. If you or your former employer no longer have any records for those years and you used a tax service to file your returns, you may begin by contacting the tax service to see if they have records of your returns. If you qualify as low-income, you may be able to contact a number of low-income or pro bono tax agencies that can assist you at no cost. For example, Albany Law School and the The Legal Aid Society of Northeastern New York both have Low-income Taxpayer Clinics which has law students, under the supervision of an attorney, represent clients at no cost. Lastly, if it is determined that you do owe the debt, you may qualify for an Offer In Compromise, a payment plan which help pay back the debt, a small amount at a time. I have negotiated Offers In Compromise for as little as $25 or $50 per month when the client's income was low enough.
