East Hampton, NY asked in Medical Malpractice for New York

Q: I live in Suffolk NY, is it possible to sue a plastic surgeon for malpractice?

The original surgery was in November 2021, the stitches came undone because I was throwing up all night (the day of surgery). Revision surgery happened in May 2023, after that, I have a bulge on my stomach that is painful and noticeable. The doctor has tried to fix it unsuccessfully, even did a minor surgery through my belly button on November 14, 2023. The bulge is still there, it is apparently scar tissue. He says another "surgery" will probably be the right thing to do. I am not sure if I want him to open me out again. I am thinking about suing him. From May until now I have been subject to several follow-up visits, and everything they poked and tried to fix it, nothing is working, Im walking around with gauze in my navel because fluid is coming out of it at all times. This is seriously messing up my self-esteem and my daily life in general.

A: A malpractice case is possible, though the extent of your harm may limit the case's viability. You should confer with other doctors to determine what should be done and the nature and extent of your future harm.
