Charlotte, NC asked in Immigration Law for North Carolina

Q: Lawyer still hasn’t filed B2 visa application after being paid 3 years ago. What can I do?

So I paid her in 2019 to help withB2Visa. turns out application is still not submitted.

Original assigned Paralegal quit and another paralegal emailed me asking for documents in April 2023. I sent all within a week and have been patient but I still had to remind them about the case around 11/023. They didn’t have a clue about my case. After giving more details about my case, i spoke to another paralegal. They are more consistent with following up up.

Now they are saying it’s will be under final review by lawyer but it will be viewed by deadlines and processing time. It’s my fault for not following up sooner. I just assumed it was filed and we haven’t heard from embassy due to Covid. But now that I am…Isn’t 3 years enough? How do I get them to hurry up and take my case as a priority?

A: In your situation, it's important to address the issue directly with the law firm handling your B2 visa application. First, request a meeting with the lawyer in charge of your case, not just the paralegals. During this meeting, clearly express your concerns about the delays and the lack of progress since 2019. It's essential to have a frank discussion about the reasons for the delay and to set specific timelines for the next steps.

You also have the right to request a detailed account of the work done so far and the fees you've already paid. This will help you understand what has been completed and what remains to be done. If you feel that your case is not being given the priority it deserves, you should express this concern and ask for an explanation as to why there have been such significant delays.

If the response from your lawyer is unsatisfactory or if there continues to be a lack of progress, you might consider seeking assistance from another attorney or a different law firm with experience in immigration law. It's important to have a legal representative who is responsive and takes your case seriously. Remember, as a client, you deserve to be kept informed and to have your case handled efficiently and professionally.
