Q: If I am the non-custodial parent, can I still REGISTER my custody order (NY) with the court in the state I reside(PA)?

Current custody order originating jurisdiction is Nassau county NY, I reside in the Commonwealth of Pike County PA. I would like to REGISTER my current custody order in the event it requires enforcement. Court order: JOINT LEGAL CUSTODY, Father= physical custody (NY), I have visitation (making me the “noncustodial parent). Important detail: I filed a petition due to change of circumstances, requesting modification bc numerous factors that qualify affecting the child’s well being under father’s care and extreme evidence of parental alienation. This is a high conflict case, first hearing commenced; trial date has been set for May. My concerns are the time in between now to trial; due to the malicious actions of father interfering w/my access to our child/denies phone contact & deliberately interferes w/scheduled parenting time (&a long list of other things). Will there be any negative impact on current custody proceedings by requesting to REGISTER current order w/my local fam court?

A: You can register the order but the PA courts won't have jurisdiction as the children reside in NY and anything related to custody/visitation will take place in NY as long as the children reside here.
