Q: I need to file a motion for dismissal in Kentucky family court without an attorney. How do I do that from out of state?

I have an attorney in Kentucky and have asked them to prepare and file the motion but they are not being responsive to this request and have not been adequately or accurately representing my interests since hired. I have been remotely interviewing potential new attorneys, who have suggested that a motion to dismiss probably makes more sense than paying a new retainer to a new firm. Neither party involved in the case is a resident of Kentucky, as the petitioner moved out of state immediately after filing and there are no assets in the state, so the case would then be re-filed in my state that is a more appropriate venue.

At this point I want to prepare and file the dismissal motion myself. How do I accomplish this from outside of Kentucky? Is there a specific form I use for the motion?

A: Write your motion to dismiss, serve copies of it on everyone in the case and mail the original to your clerks office.
