Q: What are our options and does she have any grounds to stand on?
We just recently got a gift from my mother. Which whom we don't speak with due to family issues. About a month ago my mom sent an email aski if we wanted to take her 9 month old puppy as she no longer wants to keep her or take care of her. After my wife and I spoke, we decided to make arrangements to pick her up. My wife did and from that day has made a few different trips to get the rest of her stuff where she gladly given us. Over the last few weeks, we registered her for dog treating glasses and she is registered with us as an emotional support dog. My wife ran into her a couple days before christmas And she told our fifteen year old son that that was his christmas present from her. That brings us to yesterday where she showed up to a place for my wife Often visits And is now demanding for her dog back that She never should have done it and she was emotionally Stressed and if we don't give her back she will Take us to court as she has lots of money And her lawyers fee will be on us.
A: You might want to send her a letter setting forth your version of what happened, as you have described here. Attach any documentation, including the email she sent you. If in fact she does consult with attorneys for the purpose of taking you to court, and that is by no means a foregone conclusion, the attorneys may want to review your letter. If they do so, they might first send you a demand letter, setting forth why they believe they will prevail in the lawsuit. From what you have indicated, it doesn't appear that she has a case.
