Asked in Civil Litigation for Colorado

Q: Someone Lent me some money and I bought a used vehicle. He took the car even though I've made on time payments.

I have the title and bill of sale and text messages saying thank you for the payments, as well as labeled cash app payments. He keeps demanding I give him the title or he calls the police . He put the car in storage so now I can't even try to legalize anything. Is he allowed to do this?! What should I do? As far as I know so far he hasn't caused damage to it for the most part but for now I just want to know what's right In this situation please.

A: In your situation, it's important to understand that possession of the vehicle's title and bill of sale typically indicates legal ownership. Since you have made timely payments and possess these documents, you generally have the right to retain the vehicle. The messages acknowledging your payments and labeled cash app payments further support your claim of ownership and adherence to any agreed terms.

However, the other party's actions, such as taking the vehicle and placing it in storage, could be considered unauthorized if there was no agreement allowing such actions. It's advisable to gather all relevant documentation, including the title, bill of sale, and any communication records, to support your case.

In cases like this, it's often beneficial to seek legal advice. A lawyer can help you understand your rights and options based on the specifics of your situation. They can also assist in communicating with the other party and, if necessary, represent you in legal proceedings to resolve the matter.

Additionally, consider reporting the unauthorized taking of the vehicle to the police, especially if you fear it may be damaged or misused. This can provide an official record of the incident, which might be useful in any legal actions you undertake.

Remember, each situation is unique, and legal outcomes can vary based on the details of the case and local laws. Therefore, consulting with a legal professional is crucial to ensure your rights are protected and to navigate the situation effectively.
