Q: can i obtain a lawyer still even though my next court date is a pre trial one?
i would like to hire a lawyer because my public deffender is not doing his best possible job for me.
A:
In California, you have the right to change your legal representation at any stage of the court proceedings, including before a pre-trial hearing. If you feel your public defender is not adequately representing you, it's within your rights to hire a private attorney.
However, it's important to act quickly. Informing the court as soon as possible about your decision to switch lawyers can help ensure a smoother transition and prevent delays in your case. The new lawyer will need time to become familiar with your case and prepare for the pre-trial hearing.
Keep in mind that the court must approve your change of counsel, but this is usually a formality. Your right to the attorney of your choice is generally respected as long as it doesn't cause unreasonable delays in the proceedings.
It's advisable to discuss your concerns with your current public defender first. Sometimes, communication can resolve misunderstandings or adjust the approach to your case. If you decide to proceed with hiring a private attorney, make sure to choose someone experienced in the relevant area of law.
