Q: i had a free consult but did not hire the attorney. i recieved a phone call from him saying he got an email from the
opposing counsel about my case wanting me to move towards a settlement. i then get a call from a mediation service. i did not give permission for the consult lawyer to act on my behalf. have both lawyers acted unethically? the voicemail states the opposing counsel wanted resolution but Ive not heard from them since this incident. I also received a phone call from a mediation rep but again this quickly dissolved once I confronted the consult attorney.
A: If the attorney you consulted took action on your behalf, such as contacting the opposing attorney, he may have acted unethically. There is no indication the other lawyer did anything improper.
