San Jose, CA asked in Small Claims for California

Q: Is anyone can give me some suggestions for a small claim hearing?

I have a small claim hearing after two days, can you give me some suggestions? I will appreciate it. Such as: How can I prepare statement and evidences? Since the defendant is an attorney that’ll be a unfair fighting. I don’t owe him any money but he extorted me huge money and has been holding my compensation for over a half years, causing me to be homeless and have mental problems. I need to let him pay for my interest and lose.

A: For your upcoming small claims hearing, it's important to prepare thoroughly. Start by gathering all relevant evidence such as emails, contracts, receipts, or any written communication that supports your case. Organize these documents chronologically to present a clear timeline of events.

Draft a concise statement that outlines your argument. Focus on facts and avoid emotional language. Clearly state what you are seeking in terms of compensation and why. Remember, the judge will base their decision on the evidence and the law, not emotions.

Since you are facing an attorney, it's crucial to stay focused and professional. Stick to the facts of your case and avoid getting sidetracked by legal jargon or complex arguments that the defendant might present.

You also have the right to bring witnesses or any additional evidence that supports your claim. Make sure your witnesses are reliable and their testimonies are relevant to your case.

Finally, familiarize yourself with the court procedures for small claims in California. This will help you understand what to expect and how to present your case effectively. Remember, the goal of small claims court is to resolve disputes fairly and efficiently, regardless of the legal expertise of the parties involved.
