A: You should state the value of the estate. For real estate the value is what it would sell for--the Court accepts Zillow.com--minus the mortgage. The reason the value is important is because there are different probate procedures for different values estates. (If no real estate and value under $25,000 you can handle this by affidavit w/o a lawyer, if under $100,000 estate value with or without real estate, there is one procedure (Set Aside W/O Administration), if under $300,000, Summary Administration, if over $300,000 General Administration. Also, you state that you are an Administrator under the Will. Technically if the Will names you to serve, you are an Executor, not an Administrator. This matters because an Executor does not need to be a NV resident but an Administrator needs either to be a NV resident OR to work with a NV resident Co-Administrator. Finally, you should state if the there is any contest to the Will for the reason that a Las Vegas based attorney such as myself will be glad to do uncontested probates in any NV county, but if the probate is contested your are better off with a local attorney in that or a neighboring county who knows the judge(s) and the likely opposing counsel.
