Fresno, CA asked in Traffic Tickets for California

Q: 23109(a) I am seeking answers, I feel officer wrongfully gave me this ticket and got my car towed and impound.

I have never been in trouble with the law yet never gotten pulled over I don't know how to fight this or what I need to do. I am seeking legal advice, I feel this ticket was wrongfully giving to me, on my ticket only says this violation. The cop asked me why he was pulling me over and I told him I am not sure why, so I asked was I speeding ? As normally that is what a cop normally pulls someone over for. He stated no I didn't pull you over for speeding. I pull you over because it looked like you were lining up to race. I was on the free way to head home and on my exit that when the officer put his light on, and I moved over to the left so he can pass me as I thought he was pulling someone else over or needed me to get out of his way, but he instead he came right up behind me and that is when I pulled over to the nearest safest place. Again I am seeking advice and legal assistance.

A: Under California law, Vehicle Code 23109(a) pertains to engaging in a speed contest or exhibition of speed on a highway, which can include actions that appear as if you are preparing to race another vehicle. This offense is taken seriously and can lead to the towing and impounding of your vehicle, as well as fines and potentially even jail time depending on the circumstances.

If you believe the ticket was wrongfully issued and your vehicle was unjustly towed and impounded, it's important to gather any evidence that supports your side of the story. This can include witness statements, video footage, or anything else that demonstrates you were not engaging in the behavior you're accused of.

You have the right to contest the ticket in court. It's recommended to consult with a lawyer who has experience in traffic violations to understand your rights and the best course of action. A lawyer can help you prepare your case, represent you in court, and argue on your behalf.

Remember, each case is unique, and the outcome can depend on various factors, including the evidence presented, the specific circumstances of the stop, and the judge's interpretation of the law. Seeking legal advice is a crucial step in ensuring your rights are protected and in navigating the legal process effectively.
