Not that easy; And doesn't matter that mother agrees. The state does not allow a parent to simply say "I'm done" except through a proper adoption proceeding or an abuse / neglect proceeding that results in termination of parental rights.
If the child's mother is married, the THREE of you could agree to a step-parent adoption whereby the husband becomes the child's legal father in your place. Until such time, you will remain the child's legal father, which alone does not obligate you to do anything except when it comes to a lawful child support order.
