Q: Can I sue JCPENNEY for selling fake Jewelry?

My husband spent almost $400 on what he believed was sterling silver Jewelry set as a birthday gift for me. The day after my birthday I brought it to jcpenney because the ring needed to be resized. I was told I needed to send the entire set in together in order for the ring to be resized. So that's what I did, it took them three weeks to resize and send the set back. Once i got it all back I started wearing it. Earrings, bracelet, necklace and the ring. After couple of days it started turning my skin black and the silver was wearing off showing an orange color coming through. Only to find out that the jewelry is actually brass. It does not have any stamp for sterling silver either. Only SUN & BR

After doing a Google search, I found they had a class action lawsuit for this very thing selling "fake Jewelry". I had all the receipts, protection plan and sticker with price and description and brought it back yesterday for a refund. They refused. They sold it claiming it to be pure silver.
