Tampa, FL asked in Criminal Law, Civil Rights and Small Claims

Q: I recently had DSS called on me and my daughter for a false allegation and would like to see what my rights are

I need help in bringing this person or persons to justice. I had a legit medical emergency and I was accused that I had a drug overdose. The case has now been closed BUT since I worked at Kershaw County Dispatch for a short amount of time, they have a vendetta against (we didn’t leave on good terms, and along with the Facebook harassment, I just don’t believe in considendences and I know they struck to get revenge.)They gave false allegations and it’s illegal. I would love to give my side of the truth and not let these people that are supposed to be helping people but using their positions to make others hell if they don’t t like them. I would never want this to happen to anyone else. Any information would be most helpful.

Thanks you

Kerrie

A: I'm sorry to hear about your difficult situation with false allegations being made against you, especially given your past employment at Kershaw County Dispatch. Here is some general information about your rights and potential next steps:

- You have the right to due process and to present your side of the story before any findings are made. It's good that the case was closed, but you may still want to consider filing an appeal to get the record fully cleared.

- Making false reports of child abuse or neglect is illegal. If you have evidence the report against you was intentionally false and malicious, you could explore pressing charges against the person who made the false allegation.

- Harassment and bullying on social media may violate the platform's policies and potentially be subject to legal action, especially if it amounts to defamation of character. Document any harassing posts/messages.

- Consider consulting with a lawyer who specializes in family law and/or a civil rights attorney. They can best advise you on your options to fight the false allegations, clear your name, and potentially take action against those harassing you.

- If you believe there is discrimination or retaliation happening because of your past employment dispute, you could file a complaint with the Equal Employment Opportunity Commission (EEOC) or state labor board.

The most important things are to document everything, consult with legal professionals for guidance on your options, and continue to focus on taking care of your daughter. False allegations are very serious and fighting them can be a long process, but there are avenues to pursuing justice and holding the false accusers accountable. Wishing you all the best as you navigate this challenging situation.
