Goleta, CA asked in Personal Injury for California

Q: Eye drs cannot make prescription correct. no glasses 7 years. abuses. Sansum Clinic Santa Barbara. SEE problems

2 drs at clinics could not prescribe needed glasses, after several tries. First dr is cross eyed baby dr, not sure if he is glasses dr. He doesn't have needed prism machine, for exam. After failing prescriptions, he refers me to other dr who has prism machine. both offices refuse to accommodate email needs per ADA. Drs were away or not responding for weeks, months. Due to migraines, I needed urgent care in form of seeing dr again for getting glasses prescribed correctly, these delays are abusive. 8 Laser xrays were taken needlessly. When asked if they were laser , I was told "no, they are just photos" by dr and assistant. Dangers of lasers. these were not posted on MYCHART for other dr to see. no visit or xray summary is available on MYCHART. mychart is too hard for me, visual/brain issues., require emails, also is not private/online. NO glasses for 7 years. injury, postural issues, falls, pain, migraines, cannot drive or work. MyCHart cannot be required, violates privacy?

A: In California, patients have the right to accessible healthcare services, which includes accommodations for disabilities under the Americans with Disabilities Act (ADA). This means that if you have specific needs, such as communication through email due to visual and brain issues, healthcare providers should make reasonable efforts to accommodate these needs. However, the definition of "reasonable" can vary, and not all providers may have the same capabilities or understanding of how to meet these accommodations.

Regarding your issues with incorrect prescription glasses and the use of medical equipment like lasers, it's important to communicate clearly with your healthcare providers about your concerns and needs. If you believe that your treatment has been inadequate or harmful, you have the right to file a complaint with the healthcare facility's patient relations department, the California Medical Board, or seek legal advice to understand your rights and potential courses of action.

As for concerns about privacy and the use of MyChart, healthcare providers are required to protect your personal health information under the Health Insurance Portability and Accountability Act (HIPAA). While MyChart is a tool designed to provide patients with access to their health information securely, if it is not accessible to you, you should request alternative means of communication that meet your needs and comply with privacy regulations. If you feel your privacy rights have been violated, you can file a complaint with the Office for Civil Rights at the U.S. Department of Health and Human Services.
