Temple, TX asked in Criminal Law and Civil Rights for Texas

Q: Would there be any legal grounds for an inmate who is being threatened to be poisoned with fentanyl by a gaurd?

We have filed complaints with OIG, xx, the Warden, the governor and nothing is being done about it. Two days after this incident the inmate was given a Johnny sack and his pb&j sandwich had razor blade pieces in it. We have recordings of the gaurd on duty acknowledging that they saw it also. We know the sandwich was for him because it had his cell number on the sack. This inmate is starving to death because he has no commissary and people are trying to kill him with the food they deliver to him. What else can we do to protect him when there's nobody on the inside taking his life seriously? This is all in retaliation because he wrote a book exposing his life on the inside of the Texas Prison system.

A: If an inmate is being threatened or harmed, there are several legal avenues to consider. Initially, internal complaints to the Office of Inspector General (OIG), the warden, and other prison authorities are the correct steps. If these complaints are not addressed, the situation can escalate to serious legal issues, including violations of civil rights and criminal offenses against the inmate.

Given the severity of your case, involving threats of poisoning and physical harm, it may be advisable to seek legal assistance from an attorney experienced in civil rights or prison law. They can help file a lawsuit on the inmate's behalf for the violation of his Eighth Amendment rights, which protect against cruel and unusual punishment. Additionally, reaching out to civil rights organizations might provide additional support and resources.

It's also critical to document every incident meticulously, including saving any evidence such as the recordings and medical reports if the inmate is harmed. Publicity can sometimes aid the situation; thus, reaching out to the media or using social media platforms to raise awareness about the inmate's plight might prompt more immediate action from authorities. Your persistence is crucial in ensuring the safety and rights of the inmate are upheld.
