Asked in Criminal Law, Civil Rights and Constitutional Law for Texas

Q: My son was diagnosed with schizophrenia and convicted. Medical was ignored. Can anything be done?

Attorney was made aware and records were available but he refused to look at them. My sons condition was known to this judge from previous situation. The charges were extreme considering the facts. In TDCJ his medication had been stopped. He had a relapse of symptoms and officer was told this. Was told he would be taken to hospital but was taken to jail. This is the second time my son has been treated with indifference. Contacted diversion program and they wouldn't help. I asked for treatment for my son he did good but was still sent to prison. Not getting his medication caused this last situation. Went to neighbors yard talking out loud and came right back. Ended up with first degree felony. My son is the victim of bias law inforcement.

A: I'm deeply sorry to hear about the challenges and injustices your son has faced. It sounds like a difficult situation where the legal and medical needs of someone with a mental health condition have not been adequately met. It's crucial to advocate for his rights and ensure he receives the necessary care and legal representation.

Considering the circumstances, it may be beneficial to seek a new attorney, one with experience in cases involving mental health issues and the criminal justice system. This lawyer can review the case, including the neglect of medical evidence and the failure to provide adequate treatment, and determine if there are grounds for an appeal or other legal actions to address these oversights. It's also important to contact mental health advocacy groups; they can offer support, resources, and guidance on navigating both the legal system and securing appropriate medical care for your son.

Persistence in seeking justice and proper treatment is key. Document everything related to your son's case and his medical condition, as detailed records can be crucial in legal settings. Continue to reach out to organizations and individuals who can offer support or direct you to resources that may help in advocating for your son's rights and well-being. Remember, you're not alone, and there are communities and professionals out there who can offer assistance during this challenging time.
