Q: My dog was bite by my neighbors dog and I want to take them to small claims. Can I win?
In the yard that backs up to mine, the neighbors have a dog who has previously bit my dogs through the fence. This time, his dog bit mine so severely he required emergency medical care and surgery. Now we did call animal control and jumped through all the hoops, but supposedly without the attack fully on video there’s not a lot they can do. They did say we can go to small claims. Now I have the texts where we attempted to contact the neighbor and he ignored us, a video of my dog at the fence before it cuts off (it’s a ring it only does 1 min intervals), and a vet record specifically saying it was a dog bite. My only concern is whether or not we can actually win at small claims. Everyone seems to think so, including animal control, but they aren’t lawyers. I’m only seeking to have to medical bills covered. I have evidence to support me, but I’m not sure how much I need exactly. Any advice is appreciated!
