Santa Cruz, CA asked in Landlord - Tenant for California

Q: Building has Solar panels and I don't think they are using them.

When I moved into this tax-credit building 2015 things were well managed. Even my PG&E bill was 0 during the summer months. Over the years they had quite a few incompetent staff run the show. With PG&E rates going up and stone walling behavior from faulty property management I truly thing the Solar panel system is being neglected. I live in a small studio and barley use energy yet my bill does not reflect that....

Is there anyway I can hold the company accountable for neglecting the solar option?

A: In California, tenants have the right to benefit from solar panels installed on their rental property. If you suspect that your property management company is neglecting the solar panel system and not properly utilizing it to offset your energy bills, you can take the following steps:

1. Document the issue: Gather your past PG&E bills and any correspondence with the property management regarding the solar panels and your energy usage.

2. Review your lease agreement: Check if there are any clauses related to the solar panels and their usage.

3. Contact the property management company: Write a formal letter or email addressing your concerns and request an explanation for the high energy bills despite the presence of solar panels. Ask for a detailed breakdown of how the solar energy is being utilized and credited to your unit.

4. Seek legal advice: If the property management company is unresponsive or fails to provide a satisfactory explanation, consider consulting with a tenant rights attorney who specializes in housing law. They can help you understand your rights and advise you on the best course of action.

5. File a complaint: If the issue remains unresolved, you can file a complaint with the California Public Utilities Commission (CPUC) or the California Department of Consumer Affairs.

6. Consider involving the tax credit agency: If the building receives tax credits, you may want to inform the agency responsible for overseeing the tax credit program about the potential mismanagement of the solar panel system.

Remember to keep all correspondence and documentation related to this issue, as it may be necessary for future legal action or to support your claims. It's essential to assert your rights as a tenant and ensure that you are benefiting from the solar panels as intended under California law.
