Q: What time frame can I give someone to remove all of their belongings from my home, storage, and truck?
Someone who has not lived with me for over a year but was allowed to store their stuff at my storage unit and home and allowed to use my vehicle. Will not give me back any of my keys due to the fact that their stuff is still at the two places and is also in my vehicle. How long can I give them to get their stuff out of my storage and of my property along with giving me back my truck? In the state of Oregon
A:
In the state of Oregon, the specific time frame for someone to remove their belongings from your property may depend on the nature of your relationship and any prior agreements. However, here are some general guidelines:
1. Provide written notice: Give the person a written notice requesting the removal of their belongings and the return of your keys and truck by a specific date. Be sure to keep a copy of this notice for your records.
2. Allow a reasonable time frame: Provide a reasonable amount of time for the person to remove their belongings and return your property. A reasonable time frame is typically between 14 to 30 days, but this can vary depending on the circumstances.
3. Abandoned property: If the person fails to remove their belongings within the given time frame, the items may be considered abandoned property under Oregon law (ORS 90.425). In this case, you may be able to dispose of the property after following specific procedures.
4. Vehicle return: If the person refuses to return your truck, you may need to consider legal action, such as filing a complaint with the police or seeking a court order for the return of your vehicle.
It is advisable to consult with a local attorney who specializes in property law to ensure that you follow the proper legal procedures for your specific situation and to protect your rights as a property owner in Oregon.
