Milford, PA asked in Family Law, Child Custody and Civil Litigation for New York

Q: What is the correct “answer” format to an Attorney’s “Notice of Motion” & “Affirmation” papers? “Reply” v. “Response”?

Nassau County family Court: I am the moving party (& pro se litigant); i filed a Petition for Violation of Custody Order(+my sworn affidavit, respective evidence, affidavit of service etc) against Father. His Attorney filed/served me w/a “Notice of Motion” & “Affirmation” {in short summary requesting relief to 1.dismiss my petition; 2. Grant her client costs of counsel fees; for generic reaction reason: (I) “failed to state a viable claim” & (I) make “conclusory allegations” blah blah yes I’m aware of the regurgitation of basic “your honor my client didn’t do what she said because I said so” paperwork from his attorney} i am not mocking opp. counsels legal expertise or lack thereof; i am asking if there is a specific way to draft my answering papers in writing (directed by Judge to answer her “filings” prior to upcoming trial dates). Would it be proper format “Opposition in Response to Respondents’ Motion to Dismiss”? Is there a difference between “reply” and “response”? -TYIA.
