Q: If a horse is sold to a buyer and the seller has a any-reason return guarantee, is it breach of contract to not respond?
My mother and sister had gone to Texas last summer to look at buying a horse. The horse was paid for, shipped to the east coast, and had several problems with her health. She had bug and horse bites from her travel, and she has/had a problem with her back that has prevented my sister from riding her. If the seller provides this in their website("We offer trade back guarantee for all the horses we sell here at _____. We don't offer ANY MONEY BACK it is a trade out only guarantee. If you don't get along with the horse you purchase for any reason you can trade he/she into a different horse, all horses are to be returned to ________ at buyers expense, all horses are to be in same condition as they left...") Is the seller breaching the contract by just recently responding to my mother's contacting of her and not transparently honoring her guarantee?
