San Tan Valley, AZ asked in Child Custody, Divorce, Family Law and Criminal Law for Arizona

Q: Can I contest a divorce decree (not final) which grants someone custody of a minor whom they have no legal right to?

Daughter’s ex obtained a family court order for divorce against her and custody of my granddaughter. Problem is that he has never lived with my daughter and she had custody prior to his orders (not final decree) being issued in her abcense (she was never served). SHE annulled her marriage void ad initio and I also have a separate order of protection and another court order awarding me full legal decision making of my granddaughter and my daughter as she is sick. The court has removed him from the vital record as it was only there under marital presumption. He obtained legal immigration status via marriage fraud and now it’s void retroactively. He married one mo before baby born.I am not a party to his family court case/orders. Sheriff is harassing me looking to remove my granddaughter. He has not been served OOP yet from Justice court.
