Southwick, MA asked in Criminal Law for Massachusetts

Q: How can I be charged with no test results to show a positive illegal substance? What do you think could happen at court?

A state cop found an empty heroin bag, "chore" for a crack pipe and a crack pipe in my car. All with barely any residue but very small amounts. He told me I would get a summons in the mail for the possession charges and let me go. He did not find actual drugs that carried weight. Not on my physical self or my vehicle. But here's the kicker... he didn't take the heroin bag, the chore or the crack pipe. He left it all. Don't those 3 items need to be tested?? How can they charge me if they can't prove it is even drug residue? Who's to say the pipe wasn't for just marijuana which is legal in Massachusetts for recreational use. Who's to say the day I bought that bag of dope I wasn't ripped off and it was filled with powdered sugar? They left all the items they charged me with in MY possession lol.... In your opinion, when I go to court, what will most likely happen? What COULD happen? Thanks!
