Q: I am respectfully being declined by lawyers for malpractice law suit. What am I doing wrong? Please and thank you.
I had gallbladder surgery removal because I had stones. The doctor missed one and I ended up with sepsis and a second surgery for the removal of second stone. My heath has never been the same. Can someone please help me.

As I am sure you have been told, a bad outcome in a surgery does not necessarily mean that your surgeon committed malpractice.
Take your medical records to another surgeon in or near the county where you first surgery occurred and pay him/her to thoroughly review those records to determine if your first surgeon's conduct fell below the standard of care and ask him/her to prepare a detailed written report.
Then take that expert report to a lawyer who practices in the area of medical malpractice with a detailed summary of the monetary damages you sustained as a result of having to undergo a second surgery to remove the second stone and treat for sepsis (lost wages, additional medical cost you paid, etc.). Offer to pay that attorney an hourly fee to pursue your medical malpractice claim and offer to deposit a reasonable initial retainer.

A: Medical malpractice cases can be difficult. Between the laws that protect doctors and hospitals and their insurance companies, and the nature of medical malpractice cases, not all valid cases can go forward. I suggest you continue to contact medical malpractice attorneys in the state where this occurred--you may need to contact many to find an attorney, if you can at all.

A: Don't blame yourself. You are probably doing nothing wrong. These cases are costly to prosecute, which makes most med mal law firms highly selective about the cases they accept. Good luck
