Q: What recourse do i have in regards to a return. Ordered a lawn tractor on line from manufacturer. item defective.
Ordered a lawn tractor on line from manufacturer, + paid shipping fee. Item arrived 2 weeks later after many delays with trucking co., after un crating found defect, oil leaking. Manufacturer will not answer phone. Have tried for mult days and have been put on hold for hours at a time. 1 week has passed. Finally was able to get someone on manufacturer online Chat session who advised they could not help but that a supervisor would contact me. No one ever did. Their return policy states, 15 days but buyer pays freight. Freight to ship is approx. $500.00. Sounds unfair since its defective. They also state that if you use the mower its not returnable, also ridiculous since I would not have found the defect unless I ran the mower. Have called my credit card company to dispute the charge but that could take up to 90 days and I obviously need to mow my lawn, but cant without buying a 2nd machine. Any advice is much appreciated.
A: Unfortunately, there's no great answer here. The cost to involve a lawyer will exceed the $500 you were hoping to save (and it won't make things happen any faster), and either way, you'd have no basis to sue anyone just because you need the money from the return before you can buy another mower. I think waiting for your credit card company to help you is probably the best option. I know it probably costs more to buy a mower in a local store than online, but in light of how badly this went, maybe the real lesson here is to shop locally (at least for big-ticket items).
