Surprise, AZ asked in Employment Discrimination and Employment Law for Arizona

Q: Can my boss write me up for calling out on work comp (WC) & LD terms say "provide doc’s note to excuse absence" & I do?

Hit by another truck while in my work truck. Caught on dash cam and 0% at fault. Had to go outside workers comp to find out what actually was wrong with me as it took over two months to figure out I had SI Joint disfunction from the accident. WC Doc never put all my symptoms down & just told me “i don’t know why you’re having these symptoms.” So, tell him the pain is really bad and I’m putting him “in a bad spot” to ask for time off for “the strains from neck to lower back”. WC Doc looked at the mri from another clinic and said you bulging disc are very minor and referred me to a WC physicist when other doctors looked at the mri and said “I believe your SI Joint is the cause of your pain.”

So, in short, workers comp is underdiagnosing me but have pretty stiff restrictions. I can’t tell when I’m not going to feel good from this accident. I’ve had to get blindsided by my boss about my attendance and I told him everything but even with doctors notes and the Light Duty Agreement…..
